Waiver

In consideration of being allowed to participate in the activities, training, and programs of Luyando Boxing & Fitness LLC and use of facilities and equipment, I do hereby waive, release, covenant not to sue and forever discharge Luyando Boxing & Fitness LLC and its officers, members, agents, employees, representatives, executors, and all others from any and all responsibilities or liabilities from injuries or damages resulting from my participation in any activities or my use of equipment and facilities in the above mentioned Club. I do hereby release all those mentioned and any others acting on their behalf from any responsibility or liability for any injury or damage to myself including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities of Luyando Boxing & Fitness LLC or the use of any equipment at Luyando Boxing & Fitness LLC. 

I understand and am aware that boxing and full contact sports and participation in them is a potentially hazardous activity. I also understand that these activities involve risk of injury or even death, and that I am voluntarily participating in these activities. It has been advised that I should make provisions for coverage of liability within my own insurance policy.  

I acknowledge that I have and am hereby advised to seek and obtain any necessary medical clearances from my physician to undertake the physical examination prior to beginning any exercise activity. I have obtained the necessary medical clearances to participate in activities and programs. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. I am in good health not under the influence of any substance and I am capable of performing the physical activity I choose to participate in. 

I hereby agree and consent to voluntarily engage in any and all exercises and physical activity opportunities at Luyando Boxing & Fitness LLC and to voluntarily use Luyando Boxing & Fitness LLC equipment and facilities at my own risk and with the full knowledge and appreciation of any and all dangers and risks inhibited.

CONSENT TO USE IMAGE  

I do hereby give Luyando Boxing & Fitness LLC and its designers the irrevocable right to use my photograph and or video imaging as a part of their printed material, social media, website, and any promotional marketing advertisement. I hereby waive all rights to approve the finished product. I also release Luyando Boxing & Fitness LLC from any claims for compensation associated with any forms of damages, foreseen or unforeseen, associated with the use of the images or videos. 

IMPORTANT – READ BEFORE SIGNING   

I HEREBY ACKNOWLEDGE BY SIGNING THIS FORM ON BEHALF OF MYSELF AND/OR THE CHILD LISTED ON THE MEMBERSHIP APPLICATION, I AGREE THAT THE RELEASE, WAIVER OF LIABILITY, IDEMNITY AGRREEMENT, CONSENT, AND ALL OTHER TERMS ABOVE APPLY TO ME AND/OR TO THE CHILD. 

PARENT / GUARDIAN WAIVER FOR MINORS (Under 18 years of age) The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting such capacity, has consented to his/her child or ward‘s participation in the programs, activity or events, and has agreed individually and on behalf of the child or ward, to the terms of the injury waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.

Membership Term & Condition

Centre Facilities:

All gloves, ropes and equipment must be put back after use.  Appropriate gym attire must be always worn when training (including, but not limited to, t-shirt, athletic pants or shorts (NO JEANS)) Clean runners/sneakers must be worn at all times (bare feet are permissible during training however this is done under the sole risk and responsibility of the member) Members and guests of the gym must not be under the influence of alcohol or drugs.

Use of sweat towels at all times and equipment must be wiped down after use Each member must respect other gym users and behave in an appropriate manner at all times. Luyando Boxing & Fitness LLC reserve the right to rescind the rights of members not complying with the terms and conditions of the membership.

Luyando Boxing & Fitness LLC reserves the right to make reasonable alterations to the type of facilities, programs and classes provided without notice and Luyando Boxing & Fitness LLC shall not be liable for any inconvenience caused whether this be by building works or for the provision of essential maintenance services, due to matters beyond our control.  Luyando Boxing & Fitness LLC is a non-smoking facility and smoking is not permitted within the gym or building premises.

Expulsion of Members or Termination of Membership by Luyando Boxing & Fitness LLC:
Luyando Boxing & Fitness LLC may expel members or may terminate the membership of any member: Without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of Luyando Boxing & Fitness LLC, it may be injurious to the character, name or interests of Luyando Boxing & Fitness LLC or is such that it renders the member unfit to associate with other members of the Gym.
By notice in writing if any part of the annual membership fee or monthly membership charge which is due and payable remains unpaid fourteen days after the due date for payment.  Lapses in membership payment may incur an Administration charg A member whose membership is terminated by the Luyando Boxing & Fitness LLC shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their annual or monthly membership fee.

Memberships:

Memberships are non-refundable or transferable and must be paid by the agreed date.  For memberships cancelled prior to the agreed period a charge of 50% of the outstanding cost within the contract period will apply.  Failure to pay agreed membership will leave Luyando Boxing & Fitness LLC no alternative but to terminate the Membership.Membership shall be subject to these Terms and Conditions of Membership which are in force at the time, and Luyando Boxing & Fitness LLC reserves the right to make alternations to the Terms and Conditions without prior notification.

Membership charges and payment options:

I acknowledge and understand that Luyando Boxing & Fitness LLC memberships are subject to change and may vary from time to time, including pricing variation due to government surcharges which will be effective after prior notification has been given via Luyando Boxing & Fitness LLC’ website or written notification throughout the gymnasium; and I will not require Luyando Boxing & Fitness LLC to inform me of such changes by any other means of communication including but not limited to, written notice, phone or email. All members are liable to pay all applicable membership fees irrespective of actual usage of the gym’s facilities. 

Direct Debit Memberships:

Direct Debit is an automatic monthly deduction to be debited from your banking account through Luyando Boxing & Fitness LLC’ chosen provider on the nominated day of each month. This is an ongoing membership and deductions will be maintained unless the member provides authorization to cancel the direct debit. The minimum term of a Direct Debit Membership is 2 months. After the initial agreed period, the member may cancel the direct debit in writing 15 days prior to renewal of membership.  If new membership is terminated prior to the 2-month Direct Debit Membership cycle; Luyando Boxing & Fitness shall retain 50% of the outstanding costs for early cancelation.   All membership will have a validated credit card on file.   All membership fees will be run on the nominated day of each month with a designated card on file.   Luyando Boxing & Fitness will accept early cash payment one (1) week prior to the nominated day of each month if members choose not to have membership ran on designated card.  memberships cannot be cancelled or suspended within the first 1-month direct debit period.  The gym will continue to take monthly debit installments after the minimum term unless notice is received by the gym requesting termination of the membership.  

The acceptance of an application for membership of the Luyando Boxing & Fitness LLC shall constitute a legally binding agreement between the member and Luyando Boxing & Fitness LLC. The member hereby agrees also to be bound by the Terms and Conditions applicable to All Users, a copy of which can be provided at www.Luyandoboxingfitness.com or by asking at Reception.

I agree and understand the mentioned Terms and Conditions and all rights and obligations will be in force from the date of signature and I am bound by Luyando Boxing & Fitness’ Terms and Conditions of Membership, as outlined above.
